US Court Mandates Release of Kilmar Abrego Garcia from ICE Detention

A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement lacks lawful basis.

"Since his release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.

The case originates in a erroneous deportation to El Salvador in March, which US authorities later admitted was an error. Following his repatriation to the United States to face alien smuggling charges, he was detained in federal custody.

In her order, the court pointed out that the government lacks a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."

Context of the Legal Challenge

The legal proceedings center on disputed claims. Whereas the former administration argues that Abrego Garcia is a affiliate of the MS-13 gang, he vehemently disputes this claim.

He has also entered a not guilty plea to the smuggling counts, which are part of a separate trial in the state of Tennessee.
